This Purchase Contract (“Contract”) is made, and hereby entered into, on this _____ day of _________, 2025 by and between Von der Herbstluft/Autumn Air Kennel (hereafter referred to as Seller"), and _______________________________ (hereafter referred to as "Buyer"), for the purpose of setting forth the terms and conditions of the purchase by the Buyer of a purebred German Shepherd Dog/Soft Coated Wheaten Terrier (the “Dog”).

The dog sold pursuant to the terms of this agreement is as follows:

HEALTH GUARANTEE 

1. The Seller warrants that the above-described Dog is in good health and free of communicable diseases at the time Buyer assumes ownership. Buyer agrees to have the Dog examined by a licensed Veterinarian within three (3) business days of receipt of the Dog. Proof of inspection will be required prior to the Seller forwarding AKC registration papers to the Buyer. If, as a result of the examination, the Veterinarian determines that the Dog is not in good health, then within five (5) business days after the date of the examination, the Buyer may elect either to keep the Dog or return the Dog to the Seller for a full refund. If the Buyer elects to return the Dog, the Buyer shall deliver written notice to Seller within such five (5) business day period, along with a written Veterinarian's certificate stating that the Dog was in ill-health when examined. Upon receipt of the Dog, the Seller shall be obligated to refund all monies received from the Buyer toward the purchase of the Dog, and further performance under this Contract shall be null and void and neither party shall have any further claim against the other. All action taken to return the Dog shall be with the best interest of the Dog in mind, including temperature at time of shipment, non-stop flights, ground transportation, etc.  

 

2. Buyer is completely satisfied with and waives any and all claims regarding the Dog’s confirmation and outward appearance (meaning the Dog meets the breed standard at this age set forth by the American Kennel Club and the Parent Breed Club of the U.S. of said breed). 

 

3. Buyer agrees upon purchase of the Dog that the Dog will be registered with the Seller’s kennel name.

 

4. The Buyer agrees that any and all transportation costs, to and/or from the Seller's premises, will be at the cost and sole responsibility of the Buyer. 

 

5. This puppy/dog, identified in the above section, is being sold for the sum of _______ to be paid in full on D___ M____ Y______. If the balance is left unpaid by such date, Seller may, at their sole option, cancel this Contract and the Buyer shall forfeit the non-refundable holding fee of $200. The Buyer agrees that should it become necessary to sell or otherwise place the Dog with another party, the Buyer will notify the Seller in writing before taking such action. Seller shall have five (5) business days following receipt of such notice to repurchase the Dog at a sale price to be determined at that time. Seller shall then have fourteen (14) business days to exercise said re-purchase option. Exercise shall be noted in writing sent to the Buyer. Buyer's Initials: _____________ 

 

6. The Buyer agrees to maintain preventative health care of the Dog including, but not limited to: inoculations, internal as well as external parasites, heartworm preventative medication. Buyers Initials: _______________. 

7. The Buyer agrees not to start strenuous physical activity/training until the Dog has reached a minimum of twelve (12) months of age. 

       NOTE FOR GERMAN SHEPHERD PUPPY BUYERS: Seller requests Buyer waits until at least 2 years of age to get             puppy spayed/neutered.

8. Buyer agrees Dog is purchased under AKC Limited Registration. Seller agrees to lift Limited Registration upon proof of the following: 

  1. Dog is at least 2 years of age. 

  2. Basic health testing has been performed, and the dog is not suffering from or being treated for any life-style altering heritable conditions. 

  3. Hips have been cleared as normal/breed quality by OFA or PennHip with no other genetic abnormalities noted on the radiographs. 

  4. For German Shepherd Owners: The Dog has received at least a basic working title or certification through an accredited working/sport organization such as the United Schutzhund Clubs of America, American Working Dog Federation, American Kennel Club, or comparable organization. Entry level titles, such as the AKC CGC, are not considered working titles without proof of further training in a working venue. If accreditation is not available for a particular working venue, buyer agrees to provide seller adequate proof of working abilities to satisfy breeding appropriate working abilities. 

  5. Proof must be received in writing with copies of appropriate documents of said organizations.

9. The Buyer agrees that the Seller may immediately repossess the Dog upon evidence of neglect and/or abuse at no expense to the Seller, and no refund of any monies. 

10. The Buyer agrees that the Dog will reside at the home of the Buyer, and have access to a fenced yard, and not be chained or "tied out". A material condition of Seller’s entering into this Contract is the understanding that the Dog will reside in select homes with qualified owners, will be socialized properly, and will become a member of the family.  

11. This Contract is made and signed by both parties to insure the well-being and protection of this Dog. If the Buyer breaches any part of this Contract, the Seller is released from any further obligations hereunder. Should the Seller need to seek legal action against the Buyer for violations of this Contract and be successful in such legal action, the Buyer will assume any and all attorney costs and court fees.  

12. Buyer and Seller agree to waive any right either has to a jury trial and further agree that the sole venue for pursuit of any legal action hereunder shall be the Circuit Court for Charles County, MD. 

13. This Agreement shall be governed by the laws of the State of Maryland. 

LIMITATIONS OF THE CONTRACT 

This contract applies solely to the original Dog and is non-transferable to any other party. The Seller assumes no responsibility for the Dog after it leaves the premises, including but not limited to medical expenses, landlord restrictions, allergies, family disagreements, or any other reason. No refunds will be issued once the Dog has left the premises, except as outlined in section #1. No warranties or representations are made beyond what is stated in this agreement.

INSURANCE 

There are many different types of policies available should you decide to get insurance, so read each one carefully. Some only cover wellness, while others may cover partially on severe illness and/or accidents. Some begin coverage right away, some not until your puppy is 6 months old, and some 60 days after premium is paid.
